- subsequently "Carnault AG" or "Carnault" -
1 Scope
The General Terms and Conditions (hereinafter referred to as "T&C") apply to all legal transactions concluded through the online shops www.carnault.ch contact@carnault.ch (hereinafter individually referred to as "online shop").
Carnault reserves the right to change these T&C at any time. The version of these T&C valid at the time of the order is decisive, and they cannot be unilaterally changed for that order. Contrary or deviating conditions of the customer are not recognized.
The offer of products and services in the online shop, explicitly within the framework of the dealer program (hereinafter referred to as the "Offer"), is exclusively directed at customers with a residence or business address in Switzerland.
Deliveries are made exclusively to addresses in Switzerland.
For all product orders requiring a minimum age of 18 years, the customer confirms compliance with these legal requirements when placing the order.
2 Information
2.1 Product and Price
All sales prices published in the online shop represent final prices, inclusive of all taxes (especially VAT), any advance recycling fees (vRG), packaging costs, delivery costs, and all other possible fees, charges, or costs. Carnault and the dealers reserve the right to change the prices of the offered products and services at any time. The price in the online shop at the time of the order is decisive for the conclusion of the purchase contract.
2.2 Availability and Delivery Time
Carnault places significant importance on accurately indicating availibilities and delivery times in the online shop. However, due to production or delivery bottlenecks, delivery delays may occur. All information on regarding availability and delivery time is without guarantee and is subject to change at any time.
3 Conclusion of Contract
The products and prices in the online shop are considered an offer. However, this offer is always subject to the condition that the contract may be dissolved due tot he impossibility of delivery or faulty price indication.
The purchase contract for products or services from Carnault is concluded when the customer places an order in the online shop, at one of the branches, by phone, or by email (hereinafter referred to as the "Purchase Contract").
The arrival of an online order is indicated to the customer through an automatically generated order confirmation sent by Carnault to the email address provided by the customer. The receipt of the automatically generated order confirmation does not constitute a commitment that the product can actually be delivered. It merely informs the customer that the submitted order has been received by the online shop and thus, the contract with Carnault has been concluded.
4 Delivery Date
With the order confirmation, the customer is provided with a provisional delivery date, or contact is initiated with the customer to arrange an individual delivery date.
If Carnault is unable to meet the delivery deadline, the customer (excluding special orders) has the right to withdraw from the contract starting from the 30th calendar day since the originally announced delivery date. In such a case, Carnault will refund any amounts already paid by the customer in advance. No further claims against Carnault shall be entertained.“
5 Delivery / In-Store Pickup
For products from Carnault, customers have access to all delivery and pickup options as indicated in the online shop under Shipping and Returns
The customer's delivery address must be in Switzerland; otherwise, any additional costs are to be borne by the customer.
If the customer does not accept the ordered products on the agreed or displayed delivery date, Carnault reserves the right to terminate (cancel) the contract and charge the customer for the incurred delivery costs and any loss of value.
Should the customer fail to pick up products ordered for in-store pickup within 14 calendar days from the store's readiness, Carnault may terminate (cancel) the contract.
6 Shipping Costs
6.1.
If the order is over CHF 50, we deliver all products ordered through the webshop carnault.ch free of shipping costs within Switzerland and the Principality of Liechtenstein.
6.2.
For orders under CHF 50, a shipping cost share of CHF 2.40 (A-Post) per order is charged.
6.3.
Delivery to other countries is not possible.

7 Liability and Disclaimer
7.1 Liability
Liability is determined by the applicable legal provisions. However, Carnault or the dealer is in no case liable for (i) slight negligence, (ii) indirect and consequential damages and lost profits, (iii) unrealized savings, (iv) damages from delivery delays, and (v) any actions and omissions of Carnault's agents, whether contractual or non-contractual.
Furthermore, Carnault rejects liability in the following cases:
• Improper, contractually non-compliant, or illegal storage, setting, or use of the products.
• Use of incompatible replacement or accessory parts (e.g., power supply).
• Neglected maintenance and/or improper modification or repair of the products by the Customer or a third party.
• Force majeure, in particular elemental, moisture, fall, and impact damage, etc., which are not attributable to Carnault, and official orders.
7.2 Limitation of Liability
Carnault expressly excludes any liability for losses or damages of any kind, wether direct, indirect, or consequential, arising from the use of or access to the Carnault websites or from links to third-party websites. Carnault does not guarantee that the individual parts of its website function flawlessly. Furthermore, Carnault disclaims any liability for manipulations to the Internet user's computer system by unauthorized persons.

8 Payment
8.1 Payment Options
All payment claims for products and services purchased through Carnault's online shops are enforced directly by Carnault against the customer. With the conclusion of the purchase contract, the dealer assigns the entire payment claim arising from the purchase contract between him and the customer to Carnault (cession). The customer acknowledges this assignment and is obliged to make all payments exclusively to Carnault.
Payments must be made in Swiss francs.
Cash payment is only possible for products from Carnault in the case of in-store pickup. In the case of products and services from a dealer, in-store pickup, and thus cash payment, are excluded.
The following payment options are available to the customer:
• Twint
• Credit card
• Bank transfer/advance payment
• Paypal/Paypal Express
• The current payment method fees, if charged by Carnault, are visible under "Payment Options" and are detailed in the ordering process.
• For payment by credit card or
other instant payment methods, the charge is made upon ordering.
• In the case of advance payment, delivery takes place only after receipt of payment.
• For purchases on account, the customer is obliged to settle the invoice amount within 20 calendar days after receiving the delivery without any (cash discount) deduction. In the event of a partially returned delivery, the invoice amount can be reduced accordingly.
8.2 Retention of Title
Ordered products remain the property of Carnault until full payment. Carnault is entitled to make a corresponding entry in the retention of title register. Before the transfer of ownership, pledging, security transfer, processing, or transformation without the express consent of Carnault is not permitted.
9 Amendment of Order or Cancellation
Orders obligate the customer to accept the products and services. Carnault may accept subsequent changes or cancellations of customer orders at its discretion and invoice a processing compensation of 20% of the canceled order value, but at least CHF 60.–, plus any loss of value of the canceled products since their order.
10 Return of Non-Defective Goods
Under the conditions listed in the Return Policy, Carnault grants the right to return ordered products. Whether and how long the customer can return a product is visible on the respective product page under Shipping and Returns
11 Repairs Outside the Warranty
The costs for a repair outside the warranty according to section 7 are borne by the customer. For devices with no detectable faults or where the defect does not fall under the warranty according to section 7, Carnault reserves the right to charge the customer for the cost of examining the claimed defect and the shipping costs.
12 Copyright Notice
All rights, in particular copyrights, to these T&C belong to Carnault. Any reproduction, distribution, or other use is prohibited and only permitted with the express written consent of Carnault. In the event of a violation of this provision, Carnault reserves all legal steps.
